The entire real estate holdings of the Rosa Peterson Trust will be offered at public auction. These 6 tracts will be offered singularly and select tracts will also be offered in combination at bidders request and will be sold in the manner best suiting the sellers. Details on tract offerings are listed in the tract descriptions.

TRACT #1


The Northwest Quarter (NW ¼) of Section Twenty-Two (22), Township Three North (T3N), Range Twelve West (R12W) of the 6th P.M., Webster County, Nebraska (160 Acres more or less). This 160 acre tract is a combination of non-irrigated farm land, native grass and CRP land. The terrain is level to rolling and is located on an excellent county road for access.

This tract will not be offered in combinations with other tracts.

TRACT #2

The Southwest Quarter (SW ¼) of Section Eighteen (18), Township Three North (T3N), Range Eleven West (R11W) of the 6th P.M., Webster County, Nebraska (160 Acres more or less). This is a rolling 160 acre tract with native grass, CRP and excellent habitat for deer as well as turkey in the tree covered bottoms. It is located on a minimum maintenance road with little traffic. This is an excellent hunting as well as income property.

This tract will not be offered in combinations with other tracts.

TRACT #3

The Southeast Quarter (SE ¼) of Section Seventeen (17), Township Three North (T3N), Range Twelve West (R12W) of the 6th P.M., Webster County, Nebraska (160 Acres more or less). This is a rolling 160 acre tract that includes a combination of native grassland, treed areas and CRP acres. This tract is also a very productive tract for habitat and haying. Access is by minimum maintenance road.

Tract #3 will be offered separately and in desired combinations with Tracts 4, 5 & 6.

TRACT #4

The Southwest Quarter (SW ¼) of Section Seventeen (17), Township Three North (T3N), Range Twelve West (R12W) of the 6th P.M., Webster County, Nebraska (160 Acres more or less). This tract is a combination of CRP, native grass land and treed habitat areas. This is a very productive tract with minimum maintenance road access.

Tract #4 will be offered singularly and in desired combinations with Tracts #3, 5 & 6.

TRACT #5

This 160 acre tract is a great mix of native grass land, treed areas and CRP. It is an excellent habitat property as well as a great hay producer.

This tract will be offered singularly and in desired combinations with tracts 3, 4 & 6.
Access to Tract #5 is through Tract #4 or a neighboring property to the east of Tract #5.

TRACT #6

The Northeast Quarter (NE ¼) of Section 20, Township Three North (T3N), Range Twelve West (R12W) of the 6th P.M., Webster County, Nebraska (160 Acres more or less). This tract is a combination of fenced native pasture land and CRP. It is located across the road to the south of Tract #3. Access is by minimum maintenance road. This property has excellent hunting prospects as well as being a good income property.

This tract will be offered singularly and in any desired combination with Tract # 3, 4 & 5.

TERMS:  A payment equal to 20% of the purchase price will be due the day of the auction. The balance will be due at closing on or before February 15th, 2009. Final closing payments will be either by cash, certified funds or a direct wire transfer to the Real Estate Trust Account of Ruhter Auction & Realty Inc. At closing the seller will present a title insurance binder indicating marketable title vested in the name of the sellers. The title insurance costs will be paid equally by the buyer and seller.

CRP INFORMATION:  A listing of the acreage amounts of CRP is available in our PIP (Property Information Packets).  Buyers agree to succeed to the existing CRP contracts and assume all liability for non-compliance and/or early contract termination.  Buyers agree to indemnify the sellers for any non-compliance penalties and repayments caused by the buyers’ actions prior to sale closing.  CRP payments will be prorated to date of sale closing.

Possession:  Full possession will pass to the purchaser at closing subject to any remaining rights of the tenants for the 2008 crop year. Full possession will be given no later than March 1, 2009.

Taxes:  Full tax information is available in our PIP. The 2008 and all prior taxes will be paid by the sellers. 2009 and all subsequent taxes will be paid by the purchaser.
